DEFINITIONS
1.1 Agreement: These Terms and
Conditions ("Terms") constitute a legally binding agreement between
you and AGRA BIKE RIDES
1.1.1 Business Model: AGRA BIKE RIDES
primarily operates as a platform connecting vehicle
owners with renters.
1.2 User/Customer: The terms
"User," "Customer," "You," and "Your"
refer to the individual or entity that accesses our website, mobile
application, or services.
1.3 Platform: The term
"Platform" refers to our website (rentrip.in), mobile applications,
and any other digital interfaces owned and operated by Agra Bike Rides.
1.4 Services: The term
"Services" refers to the vehicle rental services, including but not
limited to motorcycles and cars, offered by Agra Bike Rides through its
Platform.
1.5 Consumer: As defined
under Section 2(7) of the Consumer Protection Act, 2019, means any person who
buys any goods or avails any service for a consideration.
1.6 Acceptance and Binding Agreement: By accessing or
using the Agra Bike Rides website, mobile application, or any other digital
interfaces operated by Agra Bike Rides, creating an account, or booking a
vehicle with us, you expressly acknowledge that you have read, understood, and
agree to be bound by these Terms and Conditions in their entirety. This
constitutes a legally binding agreement between you and Agra Bike Rides. If you
do not agree with any part of these Terms, you must not use our services or
Platform. Your continued use of our Platform or services, including browsing
the website, making inquiries, or completing a booking, confirms your ongoing
acceptance of these Terms, including any future modifications. These Terms
apply to all users of the Platform, whether registered or unregistered, and to
all transactions conducted through the Platform.
1.7 Legal Compliance Statement: These Terms
comply with the provisions of the Indian Contract Act, 1872, the Consumer Protection
Act, 2019, the Information Technology Act, 2000, the Motor Vehicles Act, 1988
(as amended), and all other applicable laws in India.
2. ELIGIBILITY
CRITERIA
2.1 Age Requirement: You must be at
least 21 years of age to rent a vehicle from Agra Bike Rides as mandated under
Section 4 of the Indian Contract Act, 1872, which requires parties to a
contract to be of the age of majority.
2.2 Valid License: You must
possess a valid driving license that authorizes you to operate the specific
type of vehicle you wish to rent, in compliance with Section 3 of the Motor
Vehicles Act, 1988. Learner's licenses are not accepted.
2.3 License Validity: Your driving
license must have been issued at least one year prior to the date of rental and
must remain valid throughout the entire rental period as per Rule 10 of the
Central Motor Vehicle Rules, 1989.
2.4 International Drivers: If you hold a
foreign driving license, you must also possess an International Driving Permit
or a valid translation of your license in English, along with your original
license, in compliance with Section 9 of the Motor Vehicles Act, 1988.
2.5 Identity Verification: You must
provide valid identity and address proof documents as specified in Section 3
below, in compliance with KYC norms under the Prevention of Money Laundering
Act, 2002.
2.6 Agra Bike Rides Right to Refuse: Agra
Bike Rides reserves the right to refuse service to anyone who does not meet our
eligibility criteria or for any other lawful reason, in accordance with the
right to contract under Section 10 of the Indian Contract Act, 1872.
3. REQUIRED
DOCUMENTATION
3.1 Identity Proof: You must
present one of the following original identity documents at the time of vehicle
pickup:
- Aadhaar Card
- Passport
- Voter ID Card
- Any other government-issued photo ID accepted by Agra
Bike Rides
3.2 Driving License: You must
provide a copy of your valid driving license authorizing you to drive the
specific vehicle type you are renting, as required under Section 3 of the Motor
Vehicles Act, 1988.
3.3 Document Verification: All documents
are subject to verification. In case of any discrepancy or failure to provide
the required documents, Agra Bike Rides reserves the right to deny the rental
without any refund of booking amounts.
3.4 Document Deposit: Depending on
the vehicle type and rental terms, we may require you to deposit original
identification documents during the rental period. These will be returned upon
the satisfactory return of the vehicle. A proper receipt acknowledging the
deposit of such documents will be provided.
3.5 Digital Verification: Agra Bike Rides
may use digital verification methods, including but not limited to OTP
verification, digital signatures, and online document validation, in compliance
with the Information Technology Act, 2000 and the Digital Personal Data
Protection Act, 2023.
4. BOOKING AND
PAYMENT TERMS
4.1 Booking Process: Bookings can be
made through our Platform, subject to vehicle availability.
4.2 Booking Confirmation: A booking is
confirmed only after payment of the specified amount and issuance of a booking
ID, constituting a valid contract under Section 10 of the Indian Contract Act,
1872.
4.3 Transparent Pricing: In compliance
with the Consumer Protection Act, 2019, all charges, including rental fees,
security deposits, taxes, and any additional services, will be clearly
disclosed during the booking process. There shall be no hidden charges.
4.4 Payment Methods: We accept
payments through various methods as specified on our Platform, including but
not limited to credit/debit cards, UPI, net banking, and wallet payments, in
compliance with the Payment and Settlement Systems Act, 2007 and RBI
guidelines.
4.5 Security Deposit: A refundable
security deposit is required at the time of vehicle pickup. The amount may vary
based on the vehicle type and will be clearly communicated during the booking
process. A proper receipt for the security deposit will be provided.
4.6 Rental Charges: Rental charges
are as per the rates displayed on our Platform at the time of booking. These
charges may vary based on factors such as vehicle type, duration, and seasonal
demand.
4.7 Promotional Offers: Any promotional
offers, discounts, or vouchers are subject to their specific terms and
conditions and cannot be combined unless explicitly stated. All promotions
comply with the Consumer Protection Act, 2019.
5. BOOKING
MODIFICATIONS AND CANCELLATIONS
5.1 Modification Policy: Bookings can be
modified up to 24 hours before the scheduled pickup time, subject to vehicle
availability and applicable modification fees.
5.2 Extension Requests: Extension
requests must be made at least 24 hours before the scheduled drop-off time and
are subject to availability and additional charges at the prevailing rates.
5.3 Cancellation Timeline and Refunds:
- Cancellations made 2 or more days before pickup
time: 85% refund
- Cancellations made between 1-2 days before pickup
time: 65% refund
- Cancellations made less than 24 hours before
pickup time or no-shows: No Refund
- Bookings confirmed on partial payments are not
refundable.
5.4 Special Bookings: For bookings in
certain remote destinations (including but not limited to Leh-Ladakh and
Tawang) and Cash on Pickup bookings, the following special cancellation policy
applies:
- Cancellations made 7 or more days before pickup
time: 50% refund
- Cancellations made less than 7 days before pickup
time: 25% refund
- Bookings confirmed on partial payments are not
refundable.
5.5 Agra Bike Rides Cancellations: If
Agra Bike Rides is unable to provide the vehicle due to unforeseen
circumstances or if the vehicle develops qualitative problems before pickup, a
100% refund will be processed along with reasonable compensation as required
under the Consumer Protection Act, 2019.
5.6 Refund Processing: All eligible
refunds will be processed within 5-7 working days to the original payment
method used for booking, in compliance with RBI guidelines for payment
reversals.
5.7 Early Returns: If you return the
vehicle before the scheduled drop-off time, No refund shall be applicable.
5.8 Cancellation Rights under Consumer
Protection Act: Nothing in these cancellation policies shall restrict your
statutory rights as a consumer under the Consumer Protection Act, 2019.
6. VEHICLE PICKUP AND
INSPECTION
6.1 Pickup Process: You must arrive
at the designated pickup location at least 15 minutes before the scheduled time
for documentation and formalities.
6.2 Vehicle Inspection: You are
entitled and encouraged to inspect and test drive the vehicle before accepting
it. Any existing damages or issues must be reported to our representative and
documented before leaving the rental location. A joint inspection report shall
be prepared and signed by both parties. In cases where a formal inspection
report is not possible, you must report any pre-existing damage by taking
photographs and sending them to Agra Bike Rides customer support before
starting your trip.
6.3 Digital Inspection Record: Agra Bike Rides
may use digital means to record the condition of the vehicle at pickup,
including photographs and videos. You will receive access to these records.
6.4 Fuel Level: The vehicle's
fuel level will be recorded at the time of pickup and must be returned with the
same fuel level.
6.5 Acceptance: By signing the
handover form and accepting the vehicle, you acknowledge that the vehicle is in
good working condition and satisfactory for your use, constituting acceptance
under the Indian Contract Act, 1872. In cases where a formal handover form is
not provided by a dealer, the act of starting the trip and driving the vehicle
away shall be deemed as your explicit acceptance that you have inspected the
vehicle, found it fit for use, and accepted it in its current condition. This
implied acceptance has the same legal effect as a signed handover form.
6.6 Vehicle Documentation: You will
receive copies of the vehicle's Registration Certificate (RC), Insurance
Certificate, and Pollution Under Control (PUC) Certificate, as required under
Section 39, Section 146, and Section 56 of the Motor Vehicles Act, 1988
respectively. These documents must be kept with the vehicle at all times and
returned upon vehicle drop-off.
6.7 Vehicle Familiarization: Our
representative will guide you through the vehicle's features, controls, and any
specific operating instructions. It is your responsibility to familiarize
yourself with the vehicle before departing.
